Unfortunately, my first meeting with clients is usually after their initial disability claim has been denied. It is understandable they didn’t know they needed an attorney.

Their doctors had told them and told the insurance company they couldn’t work, but then they find out the company doctors disagree and deny their benefits.  The claim process often becomes a debating contest between the hired consulting physicians who have never seen the claimant (and work for the insurance industry), and the primary care or specialist treating physicians who know the claimant best.  But if your claim is denied, you have the right to an appeal, and this is when an experienced disability attorney can make a huge difference in getting your benefits approved.

LONG TERM DISABILITY - DISCLAIMER

Filing for benefits under your company disability plan is usually handled through your Human Resources or Benefits office. Your primary treating physician or specialist will need to complete a form to certify that your condition prevents you from performing your regular occupation. Most company disability plans also require you to be off a certain minimum period (commonly, 6 months) prior to filing for Long Term Disability status. Many companies also offer Short Term Disability plans to provide benefits during this initial period.
